What is the maximum amount of general damages in Ontario?

In Ontario the maximum amount of general damages for pain and suffering and loss of enjoyment of life is $329,091 as of July 2008.  This amount is adjusted for inflation.

There is no limit on any other component of damages. Pecuniary losses from the date of trial onward are also general damages.  There is no maximum on pecuniary general damages.

Examples of pecuniary general damages are:

  • future loss income
  • loss of economic opportunity
  • loss of marketability
  • future medical and rehabilitation expenses
  • future care costs
  • future housekeeping
  • handyman expenses

Pecuniary: of or relating to money.
