Can a person other than me file an accident benefit claim with my car insurance company?

Yes, other people can file an accident benefit or no fault claim with your insurance company under your car insurance policy.

These people are:

  • Anyone named as a driver in your policy
  • Your spouse and dependants
  • Your spouse’s dependants
  • The spouse and dependants of a named driver
  • Anyone involved in an accident with your motor vehicle.
    This would include passengers in your car, pedestrians hit by your car, the driver and passengers in the other car involved in the accident.  This group can only claim under your car insurance policy if they do not have insurance of their own. There are some exceptions where the accident did not occur in Ontario.

The system was designed so that everyone will have no fault or accident benefit coverage if they are involved in a motor vehicle accident.
